Retirement accounts are generally non-probate assets if beneficiary designations are used, meaning they pass outside of your Will and traditional estate planning structure. Most people assume that if no beneficiary is named, the account automatically becomes part of your probate estate. In reality, the estate planning outcome depends on the plan agreement.
