Alito, 76, Thought About Retiring This Year. He'll Look Again in 2027 | 10/5/26

Episode Description from the Publisher

Justice Samuel Alito just told CBS he is considering retirement. Alito is 76, the second-oldest justice on the bench. He said he thought about retiring this year and decided to stay, because he still believes he can make a valuable contribution. He also said somebody his age has to think about it every term, and he will look at it again in 2027. That is not a resignation. It is a clock. If he leaves while President Trump is still in office, Trump gets a shot at a fourth Supreme Court justice. His first three already moved the Court to the right. Trump has also said he regrets several nominees who ruled against his administration. Confirmation is the other half of the math. Republicans hold the Senate and the White House right now. The midterms are weeks away. If Democrats take the Senate, a fourth Trump pick gets a much harder path. Alito is not playing that chess game in public. He told CBS it is too hard to predict the political situation or what any president might do with a replacement. On Fox, he called the retirement talk vultures circling. He also defended Dobbs, the decision that overturned Roe, said the leaked draft took courage, and said he lost old friendships over it. Pat also covers: -No. 10 BYU grinds out a 17-10 win at TCU in the rain. Bachmeier goes 11-for-24 for 62 yards and has to run it in. -Angela Paxton cuts a GOP ticket ad, "elephant in the room," and never says Ken Paxton's name. -Ken Paxton sits down with daughter Mattie for a fatherhood chat. Soft questions and sounds like a campaign closer. -Pat-heads call in on daylight saving time, and why moving the clocks is still a bad deal for the country. -Zach Bryan wears a "Free Palestine" shirt onstage at Gillette Stadium. Country crowd, 73,000 people, and that shirt. Why. Should Alito have stayed on this term, yes or no? If he does step down in 2027, do you trust Trump's next Supreme Court pick more than the last three?
